description: Defendant appealed his conviction of second-degree murder,
contending (1) the district court erred in finding him competent to stand
trial; (2) the court erred in overruling his motion to suppress; (3) there was
insufficient evidence to support his conviction; and (4) he was the victim of
selective prosecution. The court of appeals affirmed, and declined
defendant's request that the selective prosecution claim be preserved for postconviction
relief proceedings. Defendant seeks further review.
