Ready date: 3-30-09
Case context: Defendant in a
prosecution for operating while intoxicated (first offense) obtained
discretionary review of a district court ruling granting the State's motion to
dismiss the charge in the furtherance of justice. See Iowa R. Crim. P.
2.33(1). Defendant contends the court erred by dismissing the case prior
to ruling on his pending suppression motion, thereby cutting off defendant's
potential right to obtain a rescission of the revocation of his driving
privileges under Iowa Code section 321J.13(6)(2007).
