Case context:  Defendant in a prosecution for operating while intoxicated (second offense) obtained discretionary review of a district court ruling granting the State's motion to dismiss the charge in the interest of justice. See Iowa R. Crim. P. 2.33(1). Defendant contends the court erred by dismissing the case during a hearing on his motion to suppress and without ruling on the motion, thereby cutting off his potential right to obtain a rescission of the revocation of his driving privileges under Iowa Code section 321J.13(6)(2007).
