granting the State's motion to dismiss the charge in the interest of
justice. See Iowa R. Crim. P. 2.33(1). Defendant contends the
court erred by dismissing the case during a hearing on his motion to suppress
and without ruling on the motion, thereby cutting off his potential right to
obtain a rescission of the revocation of his driving privileges under Iowa Code
section 321J.13(6)(2007).
