Iowa Court of Appeals to Hear Oral Arguments at Chautauqua, Okoboji

Des Moines, May 24, 2018—The Iowa Court of Appeals will hear oral arguments in two cases at the Chautauqua conference in Arrowwood Resort and Conference Center, 1405 Highway 71, Okoboji, May 31, 2018, at 1:00 p.m.  The oral arguments are open to the public and the court encourages people to attend.

The court will hear attorneys argue the cases of Van Horn, et al. v. R.H. Van Horn Farms, Inc., et al. from Carroll County and Christie v. Crawford County Memorial Hospital, et al. from Crawford County.

Case context:

17-0324 Van Horn, et al. v. R.H. Van Horn Farms, Inc., et al.

William Van Horn and June Lindner are shareholders in R.H. Van Horn Farms, Inc., a farm corporation.  Each asserted claims of minority shareholder oppression against the corporation and John Van Horn and sought declaratory relief.  The two cases were consolidated for trial in the special business court and judgment was entered for the defendants.  Issues on appeal include: whether Lindner’s appeal is properly before this court, whether the district court erred in applying a five-year statute of limitations, denying the plaintiffs’ request to declare all corporate stock to be voting stock, and determining the plaintiffs had failed to prove their oppression claim.

17-0906 Christie v. Crawford County Memorial Hospital, et al.

Richard Christie appeals from entry of summary judgment on his claim alleging workplace discrimination in the form of sexual orientation discrimination and retaliation under the Iowa Civil Rights Act against the Crawford County Memorial Hospital and Bill Bruce.  Christie contends the district court erred in viewing the summary judgment record evidence in the light most favorable to the hospital rather than the non-moving party and in concluding there was no genuine issue of material fact as to pretext.

Iowa Court of Appeals

The Iowa Court of Appeals is an intermediate appellate court.  It reviews appeals from trial court decisions that have been transferred to the court of appeals by the Iowa Supreme Court.  A decision of the Iowa Court of Appeals is final unless the case is considered by the Iowa Supreme Court on grant of further review.  Some opinions of the Iowa Court of Appeals are published and become precedent for subsequent cases.  The majority of appeals filed in Iowa are decided by the court of appeals.

Appeals cases are a multi-judge review of a single judge’s decision.  There are no jury members at these proceedings.  Typically, the Iowa Court of Appeals decides cases with randomly selected panels that change in composition every three months.  For more information about the Iowa Court of Appeals and the Iowa court system, visit the Iowa Judicial Branch website at https://www.iowacourts.gov/ .
