Des Moines, IA. The Iowa Court of Appeals will hear oral arguments in two cases at the Lawyers Chautauqua in the Arrowwood Resort & Conference Center, 1405 Highway 71, Okoboji, Thursday, May 30, 2019, at 2:00 p.m. The oral arguments are open to the public and the court encourages people to attend.
The court will hear attorneys argue the cases of In the Matter of the Trust of Floyd F. Kallmer: L.K. v. James Kallmer and William Kallmer, a Buena Vista County case, and State v. Ricky Ryan, a Polk County case.

18-0177 In re Trust of Kallmer
L.K., a minor child, appeals the district court’s ruling on motions for summary judgment denying his entitlement to the proceeds of a trust. He argues: (1) the doctrine of equitable adoption should be changed to a “relationship test” to conform with current family demographics; and (2) the doctrine makes him a beneficiary by and through his deceased father’s share. Trust beneficiaries James Kallmer and William Kallmer cross-appeal the district court’s order for the trust to pay L.K.’s guardian ad litem’s fees on appeal.
17-2031 State v. Ryan
Ricky Ryan appeals from judgment and sentence entered upon his convictions for possession of methamphetamine with intent to deliver, failure to affix a drug tax stamp, and possession of marijuana. Ryan, who was on parole, challenges the sufficiency of the evidence to support the conviction for possession of drugs found in his apartment. He also contends the trial court erred in denying his motion to suppress the evidence found following an allegedly improper warrantless entry into his apartment for a “home visit” and alleged Miranda violations during the search of his premises.
The Iowa Court of Appeals is an intermediate appellate court. It reviews appeals from trial court decisions that the Iowa Supreme Court transfers to the court of appeals. A decision of the court of appeals is final unless the Iowa Supreme Court considers the case on grant of further review. Some opinions of the court of appeals are published and become precedent for subsequent cases. The court of appeals decides a majority of appeals filed in Iowa.
Appeals cases are a multi-judge review of a single judge’s decision. There are no jury members at these proceedings. Typically, the court of appeals decides cases with randomly selected panels that change in composition every three months.
