He maintains summary dismissal was improper because he alleges newly discovered evidence and potential Brady violations. OPINION HOLDS: Moon failed to establish that he could not have raised the newly discovered evidence earlier in the exercise of due diligence. We therefore affirm the dismissal of his PCR application.
