In the Matter of Adopting Amendments to Chapter 6 of the Iowa Court Rules, Iowa Rules of Appellate Procedure (February 29, 2024)

Chief Justice Christensen has signed an order revising the appellate procedure timelines and charts in chapter 6 of the Iowa Rules of Appellate Procedure. The timeline and charts were updated in correlation with the recent amendments to chapter 6. They will go into effect April 1, 2024.

Chief Justice Christensen has signed an order expediting the amendments to rules 6.901(4) and 6.901(5) of the Iowa Rules of Appellate Procedure to make the amendments effective immediately.

In the Matter of Amendments to Chapter 46 of the Iowa Court Rules to include Certified Verbatim Reporters (November 13, 2023)

Chief Justice Christensen has signed an order approving amendments to chapter 46 of the Iowa Court Rules, which add “certified verbatim reporter” to the definition of “certified shorthand reporter.

In the Matter of Preservation of Exhibits in Criminal Cases (October 6, 2023)

Chief Justice Christensen has signed an order authorizing clerks of court to retroactively apply new Iowa Rule of Criminal Procedure 2.21(5)(a), regarding the disposition of exhibits in class “A” felonies after the defendant is deceased, and clarifying that new rule 2.21(5)(b) applies to all criminal cases, regardless of whether the case was pending as of July 1, 2023, if there is a pending appeal or postconviction-relief action.

In the Matter of Adopting Amendments to Chapter 6 of the Iowa Court Rules, Iowa Rules of Appellate Procedure (September 29, 2023)

Chief Justice Christensen has signed an order adopting amendments to chapter 6 of the Iowa Court Rules, the Iowa Rules of Appellate Procedure. The amendments are based off of the recommendations of the Iowa Rules of Appellate Procedure Review Task Force and are comprehensive. A full, clean version of the appellate rules with all of the implemented amendments and a redlined version showing all of the revisions are provided with this order. Also provided with this order is a summary outlining all of the changes to the appellate rules. The amendments go into effect April 1, 2024. Amendments to rules 6.101 through 6.105, 6.601 through 6.603, and 6.907 are subject to a sixty-day review by the Iowa Legislative Council consistent with the provisions of Iowa Code section 602.4202.

Chief Justice Susan Larson Christensen has signed an order adopting Chapter 15 of the Iowa Court Rules, Iowa Rules of Remote Procedure. The new chapter 15 rules govern the use of remote proceedings in district court. The new rules take effect January 1, 2024.

In the Matter of Adopting Amendments to the Revised Chapter 2 Iowa Rules of Criminal Procedure (August 22, 2023)

Chief Justice Susan Christensen has signed an order adopting modifications to Iowa Rule of Criminal Procedure 2.15(1), regarding witness testimony subpoenas for hearings, depositions, and trials in criminal proceedings. Included with the order are instructions for filers regarding how to electronically submit witness testimony subpoenas to clerks of court. The revised rule is effective October 23, 2023, subject to Legislative Council review consistent with the provisions of Iowa Code section 602.4202.

In the Matter of Private Retention of Court Reporters in Civil Cases (July 21, 2023)

Chief Justice Christensen has signed a corrected order concerning the hiring of private court reporters by counsel in civil cases that repealed orders that were done in 2010 and 2023 and updated the procedure and rates. The original order referred to a “November 10, 2010 order” and a “May 1, 2013 order.” The correct references are “November 24, 2010 order” and “May 1, 2023 order.”

In the Matter of Adopting Amendments to the Revised Chapter 2 Iowa Rules of Criminal Procedure (June 30, 2023)

Chief Justice Christensen has signed an order adopting amendments to the revised Chapter 2 Iowa Rules of Criminal Procedure. The amendments modify the rule regarding the process by which a minor complaining witness can request to be interviewed or deposed outside the presence of the defendant and the rule and forms related to the issuing of arrest warrants.

In the Matter of Adopting Amendments to the Revised Chapter 2 Iowa Rules of Criminal Procedure (May 31, 2023)

Chief Justice Christensen has signed an order adopting amendments to the revised Chapter 2 Iowa Rules of Criminal Procedure. The effective date of the October 14, 2022 submitted rules and November 7, 2022 revisions remains July 1, 2023. The rule amendments and form provided with today’s order are temporarily adopted effective July 1, 2023, and will take permanent effect subject to Legislative Council review consistent with the provisions of Iowa Code section 602.4202. The July 1, 2023 effective date includes criminal cases filed after that date and criminal cases already pending on that date; however, judicial districts or individual district judges may, in the exercise of their discretion, exempt any case that was pending before July 1, 2023, from one or more of the revised rules.

In the Matter of a Remote Proceedings Task Force (March 10, 2023)

Chief Justice Christensen has entered an order establishing a Remote Proceedings Task Force. The task force is charged with providing recommendations to the supreme court for the use of remote technology in court proceedings. The task force is divided into four work groups: criminal, civil, family, and juvenile law.

In the Matter of Adopting Chapter 70 of the Iowa Court Rules, Rules of Juvenile Court Services Directed Programs (December 2, 2022)

Chief Justice Christensen has signed an order adopting Chapter 70 of the Iowa Court Rules, to take effect July 1, 2023. In the Matter of Adopting Amendments to Chapter 16 Regarding Exhibit Maintenance Orders and the Filing of Social Records in Juvenile Court Proceedings (October 4, 2022)

On September 19, 2022, Chief Justice Christensen signed an order adopting amendments to the Chapter 16 Iowa Rules of Electronic procedure. The amendments required that social reports and social records be filed using the correct corresponding Electronic Document Management System (EDMS) document type as well as removed the exemption from exhibit maintenance orders for juvenile court proceedings. The amendments took effect Monday, October 3, 2022. A background memo and instructions for filers accompanied the court’s order and rule amendments.  

On October 4, 2022, Chief Justice Christensen signed an order amending the September 19 order. The amended order clarifies which documents should continue to be filed as proposed exhibits in juvenile court proceedings and corrects an error in the background information memorandum attached to the September 19, 2022 order.

In the Matter of the Iowa Business Specialty Court (January 18, 2022)

Chief Justice Christensen has signed an order adopting an amended memorandum of operation for the Iowa Business Specialty Court. The amended memorandum changes the State Court Administrator's report on the business court from annual to biannual and provides for the appointment of a settlement conference judge in business court cases. No substantive amendments were made to the business court's operation or procedures.
