Bodensteiner Implement Company seeks further review after the court of appeals reversed the district court’s grant of summary judgment on the appellant’s express-warranties claim. Bodensteiner claims the court of appeals erred in finding there must be a factual determination as to whether an oral statement created an express warranty before the effectiveness of a disclaimer can be determined and by finding there is a genuine issue of material fact regarding whether the oral statements constituted an express warranty when such statements were not a basis of the bargain.
