Case No. 16-0279

State of Iowa
v.
Thierno Yaya Diallo

Defendant appealed from the judgment and sentence entered on his guilty plea to assault causing bodily injury. Defendant contended the plea was not entered knowingly and voluntarily because he was not advised about the potential immigration consequences of the plea, and he was not informed about the applicable surcharges that could be assessed as part of his sentence. The court of appeals vacated the conviction and remanded for further proceedings, finding the plea invalid because of the court’s failure to advise about the surcharge. The State seeks further review.
