In the Matter of Property Seized from Jean Carlos Herrera and Fernando Rodriguez

In this consolidated appeal, the appellants are seeking further review from the court of appeals’ opinion that found the district court’s order of forfeiture as to Herrera was improper and remanded the matter to allow the district court to make a probable cause determination in accordance with Iowa Code section 809A.16(3); and as to Rodriguez, the district court did not abuse its discretion in finding that the attorney fees requested and presented to the district court were solely attributable to the representation of Herrera where counsel made no effort to itemize the fees.
