Robert Milas seeks further review of the court of appeals’ decision affirming the district court’s dismissal of his fraudulent misrepresentation claim on summary judgment and its refusal to instruct the jury on this claim. Milas argues there was substantial evidence to support all of the elements of a fraudulent misrepresentation claim. He further claims the district court erred in refusing to give a jury instruction on punitive damages as there was substantial evidence that Society Insurance acted with malice.
