In the Interest of Q.G. and W.G., Minor Children
The father is seeking further review after the court of appeals affirmed the juvenile court’s order terminating his parental right in a private termination action. On further review, the appellant questions whether a juvenile court has jurisdiction in a private termination action under Iowa Code chapter 600A to terminate a parent’s parental rights when a district court has previously and specifically retained jurisdiction over the custody matter arising out of the parties’ dissolution in the court’s dissolution decree. He further argues that if the juvenile court did have jurisdiction to hear this termination matter under Iowa Code chapter 600A, whether it was appropriate for the court to consider evidence occurring prior to the district court’s most recent child custody order, essentially allowing a party to re-litigate custody determinations already made by a prior court.
Grant C. Gangestad for appellant.
Dani L. Eisentrager for appellee.
Lynn Collins Seaba, guardian ad litem for the minor child.
