The State seeks further review of a court of appeals opinion that concluded Troy Williams’s PCR counsel committed structural error when counsel failed to present any of Williams’s PCR claims that resulted in the claims being decided without a record and without adversarial testing. The court of appeals remanded the case to the district court for a new hearing on the merits of Williams’s application for PCR with new counsel. The State argues the court of appeals recognized a new type of structural error, and its opinion conflicts with or substantially modifies Lado v. State, 804 N.W.2d 248, 252 (Iowa 2011).
