Case No. 18-0316

George E. Struve, Petitioner by Substitute Petitioners Dianne Lawrence, Paul Struve, and Ronald Struve
v.
Perry Struve and Clayton Struve

Substitute petitioners, who filed a petition for relief from elder abuse on behalf of their father, petitioner George Struve, appeal from a district court order that granted the petition in part and denied it in part. They contend the district court erred in (1) finding petitioner was not a vulnerable elder at the relevant times in 2014 and 2015; (2) finding petitioner was not a victim of financial exploitation by respondents; (3) ruling the substitute petitioners had no ability, and the guardian ad litem had limited ability, to waive any attorney–client privilege held by petitioner; (4) ruling that a limited liability company cannot be found to have committed elder abuse; (5) ruling the substitute petitioners could not amend their petition to add common law causes of action held by petitioner against respondents; (6) ruling that an action under Iowa Code chapter 235F is a summary proceeding.
