The Department of Human Services (DHS) appeals from a district court ruling on judicial review reversing the DHS’s decision to deny petitioner a hearing to contest the rejection by Delta Dental, one of DHS’s managed care organizations, of his claims for payment for dental services he provided to Medicaid patients. The DHS contends the district court erred by failing to find: (1) Iowa Code section 249A.4(11)’s mandate to provide state fair hearings relates only to Medicaid members and not providers; (2) Medicaid providers are not authorized to bill Medicaid members for services not paid by DHS’s managed care organization; (3) DHS need not provide administrative hearings to providers like petitioner under the applicable administrative rules; and (4) petitioner is not entitled to attorney fees under Iowa Code section 625.29.
