Alex Westra challenges the district court’s denial of his petition for judicial review seeking to rescind a driver’s license revocation for refusing a breath test under Iowa’s implied consent law. Westra argues: (1) the Iowa Department of Transportation (IDOT) officer violated his rights under article 1, section 8 of the Iowa Constitution by exceeding the scope of the officer’s legal authority; (2) the exclusionary rule under article 1, section 8 of the Iowa Constitution should apply in an administrative proceeding challenging license revocation; and (3) Westra’s substantive and procedural due process protections under article 1, section 9 of the Iowa Constitution were violated when he was not allowed to challenge the legality of the stop at the administrative proceeding.
