Case No. 18-1600

Deborah Ferguson
v.
Exide Technologies, Inc. and Fred Gilbert

The defendants appeal from the district court’s orders granting summary judgment to the plaintiff on her wrongful discharge in violation of public policy claim and granting the plaintiff attorneys’ fees and expenses on her statutory claim for violation of Iowa’s drug testing statute. The defendants argue the district court erred in denying their motion for summary judgment on the wrongful discharge claim because Iowa Code section 730.5 contains the exclusive remedy for a violation of the drug testing statute. They further claim the district court’s award of attorneys’ fees and expenses was in error because it included fees and expenses that are not related to or necessary for pursuit of the statutory claim.
