Jefferie Scott Gray, Janice Gray, an J.G., as Successors in Interest to James Lee Hohenshell

Michael B. Oliver, Oliver Law Firm, P.C. and Oliver Gravett Law Firm, P.C.,

Parents and their minor daughter obtained a civil judgment against the man who sexually assaulted the daughter and are seeking to recover the judgment from the man’s trial counsel and his law firm. They appeal the district court’s grant of summary judgment in the defendants’ favor on the basis prosecution of the malpractice case against the attorney and his law firm was against public policy. The plaintiffs argue: (1) the district court’s determination that it has the power to establish public policy is in error; and (2) the district court’s determination that Iowa does or should have a public policy that protects lawyers in this circumstance is in error.
