Case No. 19-1572

Earl Freer, as Successor Administrator of the Estate of Nicole J. Sansom, and Michael Sansom, Individually
v.
DAC, Inc. d/b/a/ Prairie House

Earl Freer and Michael Sansom (Freer) appeal from the district court’s order denying their motion to enforce the parties’ high-low settlement agreement. They argue the court erred in determining the case terminated at the conclusion of the prior appeal, Freer v. DAC, Inc., 929 N.W.2d 685 (Iowa 2019). They further argue the entry of judgment for DAC, Inc. (DAC) was consistent with the jury’s verdict and an expected prerequisite of the agreement, and the judgment did not foreclose enforcement of the agreement.
