Plaintiff, through relator Gary Dickey, appeals from a district court order denying his application for leave to commence an action in quo warranto challenging the governor’s appointment of defendant as a district court judge. Relator Dickey contends the district court erred: (1) by denying him permission to file the petition and proceeding to rule the governor’s appointment of Judge Besler was timely under article V, section 15 of the Iowa Constitution; and (2) by failing to rule he has standing to bring the petition.
