Patrick Barrett, Jr., who was convicted of second-degree sexual abuse following a jury trial, appeals from the denial of his motion for a new trial following a remand from the court of appeals ordering the district court to disclose the exculpatory evidence contained in the victim’s mental-health and counseling records pursuant to Iowa Code section 622.10(4)(a)(2)(c), and then consider whether a new trial is necessary. Barrett argues the district court erred in denying his motion for a new trial and in misapplying the standard.
