Julian Toney appeals from the district court’s ruling dismissing and denying his claims via partial summary judgment, and ordering him to pay actual and punitive damages following a bench trial. He argues: (1) the court erred in ruling the judge that considered and ruled upon the motion for summary judgment and subsequent motions for reconsideration should have disclosed facts and circumstances regarding a possible need for disqualification; (2) the court erred in granting a motion to strike his resistance to the motion for summary judgment as untimely and unresponsive; (3) the court erred in granting partial summary judgment; (4) the court erred in awarding $62,100 in damages for slander of title for lack of proof; and (5) the court erred in awarding punitive damages.
