Terry and Christine Jones (plaintiffs) filed suit against The Glenwood Golf Corporation (Glenwood) after Terry was injured as a passenger in a golf cart owned by Glenwood. At trial, the jury found the driver of the golf cart 100% at fault and awarded plaintiffs $500,000 in damages on their owner liability claim pursuant to Iowa Code section 321.493. The plaintiffs filed a motion for new trial on the issue of damages, which the district court granted. Glenwood appeals, arguing the district court erred in its application of the Iowa Comparative Fault Act, erred in failing to grant summary judgment to Glenwood on the plaintiffs’ owner liability claim, and abused its discretion in granting a new trial on damages.
