Following the remand ordered in State v. Lilly, 930 N.W.2d 293 (Iowa 2019), defendant appeals from the district court ruling rejecting his claim that the jury at his criminal trial was not drawn from a fair cross-section of the community. Defendant contends the court erred in denying his motion for a new trial because he established that his jury pool was more than 1 standard deviation from the expected number of African-Americans in the jury pool, and the jury selection process disproportionately excluded lower income populations resulting in the systematic exclusion of African-Americans from jury pools.
