Caesar Charles Davison appeals the sentence and order of restitution following his convictions for assault causing serious injury and conspiracy to commit a forcible felony: murder. Davison argues: (1) the district court violated his due process rights by imposing a $150,000 restitution award but failing to require a jury finding that he caused the death of another person; and (2) the district court abused its discretion by not considering the possibility of probation, mistakenly believing that the defendant was not eligible for probation.
