Myranda Rincon appeals from the judgment of sentence for possession of marijuana, second offense, following her stipulation to a prior offense and a trial on the minutes of testimony. Rincon was a passenger in a vehicle that police believed was stolen and in which open containers of alcohol and baggies of methamphetamine were found in plain view. She contends the court erred in denying her motion to suppress evidence obtained from a warrantless search of her backpack, which she took with her when she exited the vehicle. She argues no exception to the warrant requirement justified the search, and asks the court to overturn State v. Eubanks, 355 N.W.2d 57 (Iowa 1984), to the extent it permitted the search of her backpack.
