Rodrigo Adolpho Amaya

State Public Defender

The State Public Defender appeals from a district court order granting the defendant’s motion for services at state expense and finding Iowa Code section 815.1 unconstitutional as applied under the Sixth Amendment of the United States Constitution. The State Public Defender argues the statute does not deny the defendant the right to counsel, the right to effective assistance of counsel, or the right to hire private counsel of choice. It further argues the statute does not deny the defendant due process of law or violate equal protection.
