Riley Drive Entertainment I, Inc. d/b/a Tonic Bar, et al.
v.
Governor Kimberly K. Reynolds, in Her Official Capacity as governor of the State of Iowa; and Iowa Department of Public Health

Plaintiffs, owners of bars which were temporarily closed during the Covid-19 pandemic under a proclamation issued by defendant, appeal from a district court order which granted defendants’ motion to dismiss their action for declaratory and injunctive relief. Plaintiffs contend the district court erred by: (1) wrongfully considering alleged facts not contained in the petition and failing to allow plaintiffs to be heard prior to taking judicial notice of certain facts; (2) finding their action for injunctive relief was moot and that no exception to the mootness doctrine applied; and (3) finding their petition failed to state a claim on which relief could be granted.
