Defendant appeals the sentence entered on her guilty plea to operating a motor vehicle while license is barred, as an habitual offender. See Iowa Code §§ 321.555, 321.560, 321.561 (2021). Defendant contends: (1) the district court’s decision to impose a jail sentence because she lacked the ability to pay a fine constituted an abuse of discretion and violated her constitutional rights to due process and equal protection; (2) the court erred by ordering restitution for court costs and attorney fees under a new statutory provision rather than the prior versions in effect at the time of her offense; and (3) if the newer provisions are applicable, Iowa Code section 910.2A violates the right to due process, the right to counsel, and the excessive fines clause.
