Arzel Jones

Arzel Jones filed a pro se notice of appeal from the denial of his application for postconviction relief. Jones argues the district court (1) erred in denying his ineffective-assistance-of-counsel claims, (2) abused its discretion in denying his investigator and expert requests, and (3) prevented him from presenting evidence in support of his actual innocence claim. Jones further argues Iowa Code section 822.3A(1)—which prohibits pro se filings from applicants who are represented by counsel—does not apply to his notice of appeal. If it applies, Jones argues the statute violates the separation of powers doctrine. Alternatively, Jones requests this court grant a delayed appeal.
