Robert “Terry” Benda, a former race-horse owner, claims Prairie Meadows underpaid “purse supplements” and “breeder’s awards” from 2012–2018. The intervenors, Iowa Horsemen’s Benevolent and Protective Association (IHBPA) and Iowa Thoroughbred Owners Association (ITOA) opposed Benda’s motion to certify a class action on a claim for breach of written contracts. Benda argues the district court violated Iowa’s class certification rules, misapplied Iowa law, and reversed Iowa’s liberal class action standard; thereby abusing its discretion in denying class certification.
