Case No. 21-0831

State of Iowa, ex rel, Attorney General of Iowa
v.
Travis Autor, Regenerative Medicine and Anti-Aging Institutes of Omaha, LLC, and Omaha Stem Cells, LLC

Defendants in State’s pending action against them under the Iowa Consumer Frauds Act were granted interlocutory appeal from a district court order denying their request for a jury trial. They contend the court erred because: (1) article 1, section 9 of the Iowa Constitution entitles them to a jury trial where the State is seeking civil penalties, a money judgment in the amount of defendants’ gross receipts, and joint-and-several liability; and (2) these remedies are inconsistent with the requirement of “equitable procedures” in the Iowa Consumer Frauds Act.
