Hills & Dales Child Development Center (Hills & Dales) appeals the district court’s decision on judicial review affirming the Iowa Department of Education’s declaratory order. Hills & Dales argues the district court erred in holding that: (1) the Iowa Department of Education did not exceed the authority conferred upon it by any provision of law; (2) Applied Behavior Analysis (ABA) services is a “related service” and not a “medical service;” (3) the Department did not rely on Keystone’s representations not supported by the evidence regarding school attendance: (4) the Department’s ruling was not based upon an unjustifiable or illogical interpretation of law; and (5) the Department’s ruling was neither arbitrary nor capricious.
