Plaintiffs appeal from a summary judgment dismissing their action for declaratory judgment alleging defendant school district violated statutory procedures in rejecting their petition for a public referendum on a resolution concerning funding for an athletic stadium. Plaintiffs contend the court erred by: (1) finding their petition failed to meet the 30% threshold required by Iowa Code section 423F.4(2)(b)(2019); (2) failing to find the school district waived any deficiency in the petition by not complying with Iowa Code section 277.7; and (3) failing to find the district’s refusal to hold the referendum violated plaintiffs’ Due Process rights.
