John Hanes III appeals his guilty-plea conviction for criminal gang participation, a class “D” felony. Hanes argues his guilty plea lacked a factual basis. Hanes further argues he should not be barred from challenging his guilty plea on appeal when the district court failed in its duty to ensure there was a factual basis for the plea, or failed to arrest judgment pursuant to Iowa Rule of Criminal Procedure 2.24(3)(c).
