Maurice Edward Sallis appeals following his conviction and sentence for possession of a controlled substance – to wit cocaine, with intent to deliver and subject to enhancement, drug tax stamp violation, driving while barred, and operating while intoxicated. Sallis argues: (1) the district court erred in overruling his motion to suppress evidence as neither a completed misdemeanor, nor stale information, will support a finding of reasonable suspicion or probable cause; (2) the district court erred in denying his right to enlist the services of his counsel of choice based upon the State’s request to remove attorney Montgomery from his case; and (3) the district court erred in failing to grant a mistrial after the State elicited testimony depicting Sallis as a flight risk.
