Jim Nahas, a former Polk County Human Resources Director, filed suit against Polk County and various county officials challenging his termination and the release of a public record documenting the reasons for his termination pursuant to a public records request. The defendants filed a motion to dismiss for plaintiff’s failure to plead and set forth claims that were “clearly established” at the time of the alleged violation pursuant to Iowa Code section 670.4A(3), and failure to state a claim upon which relief can be granted pursuant to Iowa Rule of Civil Procedure 1.421. The district court denied the motion to dismiss. The defendants were granted an interlocutory appeal of the district court’s ruling.
