The defendants were granted an interlocutory appeal of the district court’s ruling on plaintiff’s motion for summary judgment/declaratory judgment. In granting the motion, the district court concluded an amendment to Iowa Code section 70A.28(5)(a) (2019) (Iowa’s whistleblower statute)—which allows an aggrieved employee to recover civil damages in an amount not to exceed three times the annual wages and benefits received by the employee prior to the violation—is remedial in nature and applies retroactively to plaintiff’s whistleblower claim. The defendants argue: (1) the amendment does not apply retroactively; (2) the law of the case forecloses a jury trial and civil damages; and (3) plaintiff waived any argument that his whistleblower claim is not equitable.
