Thomas L. Cardella & Associates (TLCA) appeals from the judgment for Jena McCoy on her negligent supervision and/or retention claim against her former employer. TLCA argues Ms. McCoy’s claim was based on alleged sexual harassment in the workplace, and thus was preempted by the Iowa Civil Rights Act, Iowa Workers’ Compensation Act, or both. It also argues the district court erred by allowing testimony from McCoy’s therapist, failing to grant a mistrial or a new trial based on misconduct, and by failing to grant a new trial based on an inconsistent verdict.
