Defendant appeals the sentence entered on his conviction of willful injury and first-degree theft following a guilty plea. See Iowa Code §§ 708.4(2), 714.1(1), 714.2(1) (2021). He asserts the court abused its discretion in imposing a prison sentence and not granting him a deferred judgment. In a consolidated certiorari appeal, defendant also contends the court erred in finding it lacked authority to grant him a deferred judgment when reconsidering his sentence pursuant to Iowa Code section 902.4.
