Petitioner appeals a district court ruling denying the married parties’ joint petition for enforcement of an interspousal agreement conveying respondent’s pension to petitioner. Both petitioner and respondent contend the court erred in finding it lacked authority to issue a qualified domestic relations order because there was no case or controversy. They argue the court had authority to enter the order even absent a divorce or legal separation and the court’s refusal to implement their agreement violates public policy and equal protection principles under the federal and state constitutions.
