Case No. 22-1530

State of Iowa
v.
Colby Davis Laub

The State was granted discretionary review of the district court’s order granting the defendant’s motion to suppress his breath test results obtained pursuant to a search warrant. The court found it was a violation of defendant’s due process and equal protection rights for law enforcement to obtain a search warrant for chemical testing rather than invoking implied consent.
