Case No. 22-2100

State of Iowa
v.
Brandon William Lee

Brandon William Lee appeals following a jury trial from his convictions and sentence for two counts of robbery in the first degree, in violation of Iowa Code sections 711.1(1)(b) and 711.2, willful injury causing serious injury, in violation of section 708.4(1), willful injury causing bodily injury, in violation of section 708.4(2), theft in the first degree, in violation of sections 714.1(1) and 714.2, and impersonating a public official in violation of section 718.2. He argues that this court should overrule State v. Copenhaver, 844 N.W.2d 442 (Iowa 2014) that stated there was no single-larceny rule. He argues that in the alternative, even under the holding of Copenhaver, the State failed to establish sufficient evidence that he had the intent to commit two separate and distinct thefts, which is necessary for a finding of two robberies. Therefore, he contends the court imposed an illegal sentence and should have combined the two convictions for robbery in the first degree.
