Lori Randolph and Ronald Randolph

Plaintiffs Lori and Ronald Randolph and third-party defendant City of Sioux City (appellants) were granted an interlocutory appeal from the district court’s ruling denying their motion to dismiss a third-party petition filed by defendant Aidan, LLC. The third-party petition alleged negligent hiring, retention, or supervision against the City based upon allegations that a City building inspector—who inspected the premises where plaintiff Lori Randolph was injured—was not properly qualified, trained, or supervised. The appellants argue the City is immune from Aidan’s claim pursuant to Iowa Code section 670.4(1)(j), which prevents an individual from suing a city for missing a defect during the course of an inspection. The appellants further argue Aidan’s claim is barred by the public duty doctrine.
