The plaintiffs—Jessenia Burton and her parents—were granted an interlocutory appeal from the district court’s order granting the defendant’s motion to compel the plaintiffs to produce psychological test material and data from Jessenia’s neuropsychological evaluation. The plaintiffs argue disclosure of this material is prohibited in judicial proceedings pursuant to Iowa Code section 228.9, and thus it is not discoverable in a civil case until the defendant retains a licensed psychologist to receive it.
