In Kirlin v. Monaster, 984 N.W.2d 412, 417 (Iowa 2023), the supreme court reversed and remanded the dismissal of Jahn Patric and Sara Louise Kirlin’s medical malpractice petition against Dr. Christian William Jones, Dr. Barclay A. Monaster, and Methodist Physicians Clinic-Council Bluffs (defendants). After remand, the district court determined the Kirlins failed to establish good cause to excuse the untimely designation of expert testimony in accordance with Iowa Code section 668.11 and entered summary judgment in favor of the defendants. The Kirlins argue the district court erred in applying section 668.11’s deadline after remand.
