The appellants seek further review of the court of appeals decision affirming their appeal and reversing the grant of summary judgment on the cross-appellant’s negligent-empowerment claim. The appellants argue that requiring a defendant to disprove negligence under Iowa Code section 706A.2(5) violates the due process clause. They further argue that in reconciling inconsistent verdicts, the district court should not assume the jury went outside the instructions or made a finding that would violate due process. Lastly, the appellants contend the issue of whether a party has a right to try a claim in equity is a legal question upon which district courts do not have discretion.
