On appeal from the denial of his application for postconviction relief, the appellant argues: 1) the pretrial asset freeze in his criminal trial violated his constitutional rights; 2) he received ineffective assistance of counsel throughout his criminal case; 3) numerous instances of prosecutorial misconduct warranted a reversal of his conviction; and 4) his consecutive sentences for attempted murder and willful injury causing serious injury violated the merger rule and violated his constitutional right to be free from double jeopardy. The appellant contends the supreme court should overrule State v. Clarke, 475 N.W.2d 193 (1991), to the extent it holds convictions for attempted murder and willful injury do not merge.
