Defendant appealed from the judgment and sentence entered on his conviction for second-degree burglary following a bench trial on the minutes of testimony. Defendant contended the evidence that he impersonated a third party in order to induce the victim to allow him into her home to have sex was insufficient to support the conviction because the sex act he intended to commit was consensual and did not constitute sexual abuse. The court of appeals affirmed the conviction, finding defendant’s impersonation of another person who was known to the victim amounts to fraud in the fact, vitiating consent. Defendant seeks further review.
