In plaintiff’s action claiming racial discrimination in employment, defendants were granted permission to take an interlocutory appeal from a district court ruling denying their motion for a protective order. Defendants contend the district court erred in finding they had waived both attorney-client privilege and the protection of the work product doctrine by raising the Faragher-Ellerth affirmative defense. See Faragher v. City of Boca Raton, 524 U.S. 775, 118 S.Ct. 2275 (1998); Burlington Indus., Inc. v. Ellerth, 524 U.S. 742, 118 S.Ct. 2257 (1998)).
